General Terms and Conditions of develoeper.com Consulting Software Development Agency
Scope These General Terms and Conditions (GTC) apply to all contracts and services between develoeper.com Consulting Software Development Agency (hereinafter "Agency") and its clients operating both in the Federal Republic of Germany and the United Arab Emirates (UAE).
Services The Agency offers professional software development services. Exact specifications of services are defined individually in respective contracts.
Commission for Client Referral
The Agency offers a referral commission for individuals or companies that refer new clients to the Agency.
The referral commission amounts to 5% of the total revenue generated with the referred client within 12 months following the initial contract.
Commission payments are made after the client's complete payment and deduction of any cancellations or refunds.
Referrers must register with the Agency and accept the terms for client referral.
Contract Conclusion and Termination Contracts are established through written confirmation. Terms of termination are defined individually in the contracts.
Liability and Warranty The Agency is liable for its services within the scope of statutory provisions. Warranty claims are limited to rectification or replacement.
Confidentiality and Data Protection Both parties commit to confidentiality regarding all information exchanged in the context of the contractual relationship. The Agency complies with all applicable data protection laws in both Germany and the UAE.
Applicable Law and Jurisdiction
These GTC and all contracts between the Agency and its clients are subject to the laws of the Federal Republic of Germany, unless specific regulations apply for transactions in the UAE.
The legal venue, as far as legally permissible, is agreed to be the location of the Agency's headquarters.
Final Provisions
Amendments or supplements to these GTC require written form.
Should any provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
